Official Rules
NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING . Game begins on approximately 1/1/06 and ends on 12/31/09, or sooner if supplies are exhausted and all game pieces are distributed. VOID WHERE PROHIBITED .
1. ELIGIBILITY: Entrants must be a legal resident of one of the 50 United States, Puerto Rico, or the District of Columbia. If a potential prize winner is a minor under the laws of his or her state of residency, the prize may be awarded to the minor's parent or legal guardian who must assume all responsibilities of the prize winner. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of Freestyle Foods, LLC ("Sponsor"), its affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this promotion, including, but not limited to, the entities supplying the prizes herein, are not eligible to participate.
2. HOW TO PARTICIPATE:
A. WITH A PURCHASE : Purchase specially marked X grindz (TM) Instant Win Game packages of X grindz (TM) Potato Chips for a wrapped instant win game piece, while supplies last. Not all package sizes will participate.
B. WITHOUT A PURCHASE: To receive a game piece without making a purchase (while supplies last), send a self-addressed, stamped business-size envelope to: Freestyle Foods, Inc. "TEAM XGRINDZ PRO SKATEBOARD" Free Game Piece Request, 1648 Newport Blvd, Bldg. A, Costa Mesa, CA 92627. VT residents may omit return postage. Mail-in requests must be postmarked by 12/30/09 and received by 1/5/10. Limit one request per postmarked envelope per day. One unopened game piece will be sent to you for each request received, while supplies last. No facsimile, photocopies or other mechanically reproduced game piece requests will be honored. Sponsor assumes no liability for lost, late, stolen, illegible, misdirected, mutilated, incomplete or postage-due mail.
3. HOW TO PLAY: Open game piece and look inside to see if the winning X grindz (TM) Crownhead silver sticker is enclosed. If so, you are an instant winner, subject to verification. If an instant win prize is revealed, follow the redemption information on the game piece. (See PRIZE CLAIMS section of these Official Rules for further details on redemption.) If your game piece does not have the X grindz (TM) Crownhead silver sticker inside, you are not a winner.
4. PRIZES: The following prizes will be available to be awarded:
(12) prizes: a skateboard, maximum approximated retail value ("ARV") $75.00.
There will be up to 10,000,000 game pieces available for distribution in the promotion. Odds of winning a prize are based on distribution of the official game pieces. The maximum approximated retail value ("ARV") of all prizes available to be awarded is $900.00. No prize substitution or cash redemption, except at Sponsor's sole discretion, or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize becomes unavailable for any reason. Prizes are not transferable prior to award. All taxes on any prize are the sole responsibility of the winner. If for any reason, including, without limitation, a printing or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims for that prize will be entered in a random drawing from which winners for only the advertised number of prizes will be selected. No more than the number of prizes set forth in these Official Rules will be awarded. Unclaimed prizes will not be awarded.
5. PRIZE CLAIMS GENERALLY: Prize claims must be postmarked by 12/30/09 and received by 1/5/10. All prize claims will be verified by1/31/10. Please allow up to 12 weeks for shipment of your prize after verification date. Any difference between value stated herein and actual value will not be awarded. All official game pieces submitted for verification become the sole property of Sponsor and will not be returned. Potential Prize winners must mail their original potentially winning game piece (make a copy of the game piece to retain in your own records) along with a 3x5 card, on which you have legibly printed or typed your full name, complete residential address (a P.O. Box will not be recognized as a residential address) with zip code, daytime phone number, age, and e-mail address (if available) via registered or certified mail, return receipt requested, to Freestyle Foods, Inc., "TEAM XGRINDZ PRO SKATEBOARD" Prize Claims, 1648 Newport Blvd, Bldg. A, Costa Mesa, CA 92627. All prize claims are subject to verification. Upon receipt of the prize claim, the Promotion Administrator may require the potential winners, at the residential address provided by the potential winners (or potential winner's parent or legal guardian, if the potential winner is a minor), to complete, sign, notarize and return, within 21 days of receipt, an Affidavit of Eligibility and a Liability Release, and where lawful, a Publicity release.
6. GENERAL RULES OF PARTICIPATION: All prize claims are subject to verification by the Promotion Administrator whose decisions are final and binding in all respects. By participating in this game, entrants and Prize winners release Sponsor, and its parent companies, subsidiaries, affiliates, owners, employees, representatives, agents, advertising and promotion agencies and all others associated with the development or execution of this game, including, but not limited to, the entities supplying prizes herein, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the game, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. By participating in this promotion, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsor reserves the right permanently to disqualify from this game any person it believes has violated these Official Rules. All game materials and game pieces are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, seeding or other errors. Sponsor's liability for defective game materials and game pieces is limited to replacement while supplies last. Entrants assume all risk of loss, damage, destruction, delay or misdirection of game materials, pieces and mail submitted to Sponsor. Sponsor is not responsible for misdirected or destroyed mail, including, but not limited to, Affidavit and Release forms. All federal, state and local laws apply. In the event any portion of this promotion is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or proper play of the promotion or this game, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the promotion and this game. Accepting a prize constitutes permission for Sponsor and its agencies to use winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this promotion only, without further compensation, unless prohibited by law. Sponsor and its agencies are not responsible for lost, late, incomplete, incorrect, damaged, misdirected, illegible, or postage due requests, claims, entries, or prizes mailed via First Class mail. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Orange County, California.
7. PROMOTION ADMINISTRATOR: This promotion is being administered by Freestyle Foods, LLC, a California limited liability company, with its principal place of business at 1648 Newport Blvd., Suite A, Costa Mesa, CA 92627, which is responsible for overseeing the verification of winners and the awarding of all prizes. Its decisions are final and binding regarding the conduct of this promotion.
8. WINNER'S LIST REQUEST: To receive a list of Prize winners, send a self-addressed, stamped (business size) envelope to: Freestyle Foods, LLC, "TEAM XGRINDZ PRO SKATEBOARD" Winner's List Request, 1648 Newport Blvd, Bldg. A, Costa Mesa, CA 92627. Requests must be received by 2/28/10.
